Resolution Establishing a City Council Policy Regarding the Treatment of Non-Profit Organizations in Dealings with the City

WHEREAS, pursuant to N.J.S.A. 40A:12-14(c) a municipality is authorized to lease real property not needed for public use to a nonprofit corporation for a public purpose for nominal or other consideration; and,


WHEREAS, the City of Hoboken frequently leases property to non-profit organizations in accordance with N.J.S.A. 40A:12-14(c); and,


WHEREAS, it appears to the City Council that the consideration requested by the City in these leases varies, in that some non-profits are paying nominal consideration, and others are paying greater amounts; and,


WHEREAS, the City Council believes that all non-profits should be treated equally and should pay nominal consideration for any lease of City property; and,


              WHEREAS, the City Council wishes to express to the Administration that in most cases it will have difficulty approving any further ordinance authorizing a lease with a non-profit unless it appears that all non-profits are equally being afforded the opportunity for nominal or other consideration as outlined in N.J.S.A. 40A:12-14(c) or a reason is provided to account for a disparity.


NOW, THEREFORE, BE IT RESOLVED, the Hoboken City Council respectfully puts the Administration on notice that in most cases it will have difficulty approving an ordinance authorizing a lease with a non-profit unless the lease is for nominal consideration as authorized by N.J.S.A. 40A:12-14(c) except in those cases where the Administration presents to the Council that there is good cause for a specific deviation.
